Aaaarrrrgggghhh! (Sorry, I thought it needed repeating)

Ok, so last week I had got a call from the snippy b***h at the management company complaining about the amount of notice we gave for leaving. She said to call either her or John on Monday and talk to them about it. I opted for John and called him Monday morning.
I explained to him that we were moving and that snippy b***h had a problem with the amount of notice we gave. He asked me how much notice we gave and when we were leaving…I told him 33 days notice and we were leaving by new years.
He says ‘yer killin’ me’
I said ‘I’m sorry, but look at the bright side: after we’re gone you can charge more rent for these apartments.’
He laughed. At no time did he say the notice was not enough; he even wished us luck in the new place. I considered the matter to be closed after that phone call.
A week later I get another phone call. It’s snippy b***h again. (Her name is actually Pam but for venting purposes I shall call her snippy b***h…. which is actually a lot nicer than the name I call her in my head.) She reminds me a lot of Delores Umbridge from Harry Potter. She tries really hard to come off as pleasant and polite but in reality she’s very acidic and grates on your nerves.
She says ‘I called you a week ago and left a message. I thought you would’ve called me by now.’
I said ‘I called on Monday and I spoke to John.’
She says ‘Oh really? Well he didn’t apprise me of that. Did he say anything about the amount of notice you gave?’
I said ‘Nope. I told him and he didn’t say anything about it.’
She says ‘Well, I’ll just have to have a word with him about that then later. The reason I’m calling is because the notice you gave is inadequate. You’ll have to pay rent for January too under the terms of your lease.’
‘Like hell….’ I thought.
I say ‘No we don’t.’
She says ‘Yes. You do.’
I said ‘Nope, our leases expired in June 2006. That makes us ‘at will tenants’ and as such we are not legally required to give anymore notice than the period between rents. In our case that’s 31 days. There’s a Minnesota statute that addresses it.’
She says ‘Oh really? What statute is that? I’d like to read it for myself.’
I gave her the statute number and she says ‘Thanks, I’ll get back to you.’ And hangs up.
Now I’m just agitated, but I decide to not think about it and started doing up the dishes in the sink. While the water was running I didn’t hear the phone ringing and missed the call. It was snippy b***h again…this time she left a message.
She says ‘I just did some research and pulled out your leases and they are the SAME leases we’ve been using for years. If you look at the top of it, it says (and she quotes): “The Minnesota attorney general’s office has certified that this lease complies with the Minnesota plain language contract act.” That being said – the terms of your lease state that you must give 60 days notice which means your notice is inadequate and you’ll have to pay rent for January too.’
Now I am freaky pissed. Snippy b***h wants to argue and she’s adamant that she’s right. I’m certain she isn’t. The statute in question states that when your lease expires you become a month to month tenant and the rules of the lease are no longer the same, meaning you don’t have to give more notice than one rental period and if they feel like it they can raise our rent anytime they want, etc. I went to pick up Amber from work and told her all about it and we began to plan our next course of action. Then tonight just for shits and giggles I pulled out my lease to have another look – particularly at the section snippy b***h quoted. I’m glad I did. Lmao, snippy seems to think her statement meant the lease’s legality was solid…apparently she didn’t notice the next line (or she was hoping I wouldn’t). It says:
“Certification of a contract by the attorney general under the plain language contract act is not otherwise an approval of the contract’s legality or legal effect.”
* Giggles like a mad woman *
BWAHAHAHA! Oh yeah, oh yeah! CAN YOU FEEL THAT SNIPPY? How do you like me now? In your FACE you b***h!!!! * roars *
I can’t wait to hit them with that one on Monday…lol.
We weren’t even asking for our damage deposits back but now I think I want mine just cuz they pissed me off…. Anyway, sorry about the rant.
In happier news – I cashed in a bunch of my coke points on a Kodak calendar with pictures of our camping trip for my friends who went with us and I also had a couple of pictures I took made poster sized. Not to toot my own horn but my pictures look pretty damn good enlarged. biggrin also I couldn’t wait for Christmas so I gave my friends their calendar early… they loved it. Yay!

I have heard cases where the landlord, to keep the deposit have actually gone in and done some minimal damages out of spite. Clean the place and take pics, pictures speak a 1000 words.
